Privacy Policy and Terms of Service

Privacy Policy

This Privacy Policy explains how Elephant POS LLC ("Elephant POS," "we," "us," or "our") collects, uses, stores, and shares information when you use the Elephant POS website and app.

1. Information We Collect

Depending on how you use Elephant POS, we may collect the following categories of information:

  • Account information. This can include your email address, sign-in method, and authentication details associated with your account, including Sign in with Apple information and Apple private relay email addresses when applicable.
  • Business and setup information. This can include location names, employee names, owner and employee access settings, menu or catalog data, receipt settings, tax settings, and printer configuration data.
  • Transaction and operational data. This can include orders, receipts, refunds, shift records, daily sales reports, receipt numbers, and related business workflow records you create in the app.
  • Payment-related information. For in-person payments, Elephant POS uses third-party payment providers, including Stripe Terminal. We may store limited payment-related records such as payment intent identifiers, refund identifiers, payment status, and related transaction metadata needed to support checkout and refunds. We do not store full card numbers in the app.
  • Device and app data. This can include a device identifier generated by the app, device name, platform, last sign-in time, selected location, remembered sign-in preferences, and local app settings.
  • Printer and hardware data. This can include printer names, IP addresses, targets, connection details, and printer status information for supported printer workflows.
  • Location-related information. If location permission is granted, location-related information may be used to enable supported in-person payment features that require it.
  • Support communications. If you contact us, we may keep your name, email address, and the contents of your message.

2. How We Use Information

We use information to:

  • create and manage accounts;
  • authenticate users and support sign-in, password reset, and account recovery flows;
  • operate point-of-sale workflows, including catalog management, checkout, receipts, employee access, location management, printer setup, reporting, and account deletion;
  • process and support in-person payments and refunds through third-party payment providers;
  • sync business data across supported devices and cloud services;
  • maintain security, prevent misuse, and troubleshoot operational issues; and
  • respond to support requests and communicate about the service.

3. How Information Is Stored

Elephant POS stores information both locally on your device and in cloud services we use to operate the app.

  • On-device storage. The app may store operational data and settings locally on your device, including local order data, printer settings, employee access state, and certain app preferences.
  • Secure storage. Certain credentials and sign-in related values may be stored using iOS Keychain.
  • Cloud storage. Account and operational records may be stored in cloud services such as Firebase Authentication and Cloud Firestore.

4. Third-Party Services

Elephant POS uses third-party services to operate key features. These providers may process information in accordance with their own terms and privacy policies.

  • Apple. Used for platform services including Sign in with Apple, App Store subscriptions, and device-level functionality.
  • Google Firebase. Used for authentication and cloud data storage.
  • Stripe. Used for card-present payment, refund, onboarding, and payment account related services.

5. Payments

Payment processing services are provided by third-party payment partners. Elephant POS does not store full payment card numbers in the app. Payment providers may collect and process transaction data needed to complete payments, refunds, compliance checks, and fraud prevention.

6. Bluetooth and Location Permissions

Elephant POS may request Bluetooth and location permissions to support compatible card reader and payment workflows. If you do not grant these permissions, certain hardware or payment features may not function.

7. Subscriptions

If you purchase a subscription through Apple, subscription transactions are handled by Apple. Elephant POS may store subscription status and entitlement state needed to determine access to paid features.

8. Data Sharing

We may share information with service providers only as reasonably necessary to operate the app and support the services described above. We do not sell personal information.

9. Data Retention

We retain information for as long as needed to operate the service, maintain your account, comply with legal obligations, resolve disputes, and enforce our agreements. You can request deletion through the app's account deletion flow when available.

10. Your Choices

  • You can manage certain account information from within the app.
  • You can disable remembered sign-in behavior on your device.
  • You can remove the app from your device.
  • You can use the in-app delete account flow, when available, to request deletion of account data stored by Elephant POS.

11. Security

We use reasonable administrative, technical, and organizational measures to protect information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

12. Children's Privacy

Elephant POS is intended for business use and is not directed to children.

13. International Processing

Your information may be processed and stored in countries other than your own, depending on the infrastructure used by us and our service providers.

14. Changes to This Policy

We may update this Privacy Policy from time to time. If we make material changes, we may update the effective date above and post the revised version on this page.

Terms of Service

These Terms of Service ("Terms") govern your access to and use of Elephant POS. By creating an account, signing in, purchasing a subscription, connecting a payment account, or using the app, you agree to these Terms.

1. Business Use and Account Ownership

Elephant POS is intended for business use. The person or business that creates or controls an Elephant POS account is responsible for all activity under that account, including activity by owners, managers, employees, contractors, and other authorized users. You are responsible for maintaining accurate account information, protecting sign-in credentials, managing user permissions, and promptly removing access for anyone who is no longer authorized.

2. Authorized Users and Employee Access

You may allow authorized users to access your business workspace in Elephant POS. You are responsible for assigning appropriate roles, PINs, permissions, and device access. Actions taken by authorized users, including order entry, refunds, settings changes, printer changes, and payment-related actions, are treated as actions taken on behalf of your business.

3. Subscriptions, Trials, Billing, and Cancellations

Some Elephant POS features require an active subscription. Trial availability, trial length, plan features, pricing, and renewal terms are shown in the app or in the App Store purchase flow. Subscriptions purchased through Apple are billed, renewed, canceled, and managed by Apple under Apple's App Store terms. You can manage or cancel an Apple subscription through your Apple ID subscription settings. Canceling a subscription stops future renewal but does not automatically refund prior charges.

4. App Subscription Refunds

Refund requests for subscriptions purchased through the App Store are handled by Apple. Elephant POS cannot guarantee that Apple will grant a refund. If we offer any direct promotional credits, extensions, or accommodations, they are discretionary and do not create an ongoing obligation to provide similar treatment in the future.

5. Stripe Connect and Merchant Payment Accounts

Elephant POS supports merchant-owned payment processing through Stripe Connect and Stripe Terminal. Each merchant is responsible for creating, connecting, maintaining, and complying with the terms of their own Stripe account. You are responsible for your payment account information, payout settings, refunds, disputes, chargebacks, taxes, business verification, prohibited business restrictions, and all payment compliance obligations that apply to your business.

6. Merchant of Record and Customer Sales

Elephant POS is not the merchant of record for sales made by your business through the app. Your business, not Elephant POS, sells goods or services to your customers. Your business is responsible for pricing, receipts, taxes, refunds, customer service, fulfillment, disputes, chargebacks, legal compliance, and any obligations owed to your customers or payment processor.

7. Payment Hardware, Printers, and Device Limitations

Hardware features may depend on device model, operating system version, network conditions, Bluetooth, local network permissions, location permissions, Stripe Terminal availability, Tap to Pay availability, printer compatibility, firmware, and third-party SDK behavior. Elephant POS does not guarantee that every printer, card reader, payment method, network environment, or device configuration will work without interruption. You are responsible for maintaining backup workflows for checkout, receipts, refunds, and business operations.

8. Data Storage, Sync, and Backups

Elephant POS may store data locally on your device and may sync certain account, business, order, payment status, subscription, device, and operational records using cloud services such as Firebase. Sync availability depends on network access, service availability, account status, and device state. You are responsible for reviewing your records, maintaining any legally required business records, and exporting or backing up information when needed for your business.

9. Acceptable Use

You agree not to misuse Elephant POS, interfere with the service, attempt unauthorized access, bypass subscription or access controls, reverse engineer the app except where allowed by law, use the app for unlawful activity, submit false account or payment information, violate payment processor rules, or use the service in a way that harms Elephant POS, other users, payment processors, customers, or third-party providers.

10. Service Changes, Suspension, and Termination

We may update, change, limit, suspend, or discontinue parts of Elephant POS. We may suspend or terminate access if we believe an account violates these Terms, creates risk, misuses the service, violates law, infringes third-party rights, fails to maintain required payment or subscription status, or creates operational or security concerns. You may stop using the app at any time and may request account deletion where available in the app.

11. Third-Party Services

Elephant POS depends on third-party services, including Apple, Google Firebase, Stripe, printer vendors, card reader providers, and related SDKs or infrastructure. Those services are governed by their own terms, policies, availability, and compliance requirements. We are not responsible for third-party service outages, account decisions, payout delays, chargebacks, verification requirements, hardware limitations, or policy enforcement by third parties.

12. Disclaimers

Elephant POS is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free operation, and compatibility with every device, payment account, printer, reader, network, or business workflow.

13. Limitation of Liability

To the maximum extent permitted by law, Elephant POS LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost revenue, lost data, business interruption, payment disputes, chargebacks, payout delays, tax issues, hardware failures, or third-party service failures. To the maximum extent permitted by law, our total liability for claims related to the service will not exceed the amount you paid to Elephant POS for the app subscription during the three months before the event giving rise to the claim.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may update the effective date above and post the revised version on this page. Continued use of Elephant POS after changes become effective means you accept the updated Terms.
